Event Terms & Ticket Purchase Agreement

We can’t wait to share an exceptional Pinot experience with you.
These Event Terms cover what you can expect from us — and what
we expect from you — when you purchase a ticket and attend Palm
Springs Pinot Fest or any event hosted by Passion 4 Pinot
(“we,” “us,” or “our”). By purchasing
a ticket, you agree to these Terms on behalf of yourself and any
guest in your party.

1. Tickets & Purchase
Tickets are sold through our ticketing partner,
TicketSpice.
When you complete a ticket purchase, you also agree to TicketSpice’s
own terms of service. Tickets are valid only for the specific event,
date, and session printed on them.
Tickets may not be resold for profit, transferred for commercial gain,
or used for any promotional purpose without our prior written consent.
We reserve the right to invalidate any ticket sold or transferred in
violation of this provision and to deny entry to the holder.
2. Refund Policy
All ticket sales are final and non-refundable,
except as specifically described below or as required by law.
Optional Purchase Protection
During checkout, TicketSpice offers an optional add-on called Purchase
Protection, provided by Purchase Protection LLC (a third party that is
not affiliated with Passion 4 Pinot). If you choose to purchase Purchase
Protection, you may be eligible for a refund of your ticket fees in
certain covered circumstances — such as documented illness, severe
weather preventing travel, jury duty, or a death in the family.
Purchase Protection is a service offered by Purchase Protection LLC,
not by us, and is governed entirely by their terms and conditions.
Purchase Protection is not insurance. Coverage decisions, claims, and
refunds under Purchase Protection are handled by Purchase Protection LLC,

If you did not purchase Purchase Protection at checkout, your ticket is
non-refundable for any reason except as set out in Section 3 below.
Ticket Transfers
If you can’t attend, you may transfer your ticket to another adult
of legal drinking age (21+) by contacting us at
[email protected] at least
72 hours before the event. The new attendee must provide their full name
for our guest list and present valid ID at entry. Transfers are not
guaranteed and are subject to our discretion.
3. Cancellation, Postponement, or Rescheduling by Us
If we cancel an event entirely (and the event is not rescheduled), you
will receive a refund of your ticket purchase price (excluding any
third-party fees, such as ticketing service fees and Purchase Protection
fees, which are non-refundable).
If we postpone or reschedule an event to a new date, your ticket will
automatically be honored at the new date. If you cannot attend the
rescheduled date, contact us at

14 days of the rescheduling announcement to request a refund of the
ticket purchase price (excluding third-party fees).
Refunds will be processed to the original payment method within 30 days
of approval.
4. Age Requirement & Identification
All attendees must be at least 21 years of age.
Valid government-issued photo ID (driver’s license, state ID,
passport, or military ID) is required for entry. If you cannot present
valid ID, you will be denied entry without refund. This applies regardless
of how old you appear.
We do not permit anyone under 21 to attend, including infants and
children, even when accompanied by an adult.
5. Responsible Alcohol Service
Our events feature wine tasting in a controlled environment. We’re
committed to responsible alcohol service in compliance with California
Department of Alcoholic Beverage Control regulations and applicable law.
You agree to:
- Drink responsibly and pace yourself throughout the event
- Use water, food, and spit buckets, which we provide
- Arrange safe transportation to and from the event — do not drive under the influence
- Accept that our staff and pourers may decline to serve you additional alcohol at their discretion
6. Conduct & Right to Refuse Service
We want every guest to have a great time. To make that possible, we
reserve the right, at our sole discretion and without refund, to deny
entry to or remove from the event any person who:
- Appears intoxicated or impaired
- Cannot provide valid age identification
- Behaves in a disruptive, threatening, or harassing manner toward staff, vendors, or other guests
- Damages property or violates venue rules
- Brings prohibited items into the event
- Violates any applicable law or these Terms
Removed guests will not receive a refund and may be banned from future events.
7. Entry, Re-Entry, & Prohibited Items
Entry is permitted during posted event hours and is subject to capacity.
Re-entry policies vary by event and will be communicated at the venue
or in your confirmation email. Outside food and beverages, illegal
substances, weapons of any kind, professional recording or broadcast
equipment (without prior written permission), and pets (other than
service animals) are not permitted.
Bag checks may be conducted at entry. By entering, you consent to
reasonable security inspection.
8. Photo & Video Release
By attending the event, you acknowledge that we and our authorized
photographers and videographers may capture photographs, video, and
audio recordings that include your image, voice, and likeness. You
grant Passion 4 Pinot a perpetual, worldwide, royalty-free,
non-exclusive, transferable license to use these recordings in any
media — including our website, social media, email marketing,
print materials, advertising, and editorial coverage — for
promotional and commercial purposes related to our events, without
compensation to you and without further notice or approval.
If you don’t want to be photographed, please notify our event
staff and avoid camera-marked areas, and we’ll do our reasonable
best to honor that request.
9. Assumption of Risk
Attending a wine tasting event involves inherent risks, including (without
limitation) the consumption of alcohol, the presence of glassware, crowded
venue conditions, and travel to and from the event location. By purchasing
a ticket and attending, you knowingly and voluntarily assume all such risks.
You agree that you are responsible for your own safety, your own actions,
and the consequences of your alcohol consumption. You agree not to drive
or operate machinery while impaired and to arrange safe transportation
if you choose to drink.
10. Limitation of Liability
To the fullest extent permitted by law, Passion 4
Pinot, its owners, employees, agents, contractors, sponsors, vendors,
venue partners, and affiliates will not be liable for any indirect,
incidental, special, consequential, exemplary, or punitive damages, or
for any loss of profits, data, goodwill, or other intangible losses,
arising out of or related to your attendance at, participation in, or
inability to attend an event.
Our total liability to you for any claim
arising out of or related to an event will not exceed the amount you
paid for your ticket to that event.
This limitation applies regardless of the legal theory of the claim
(contract, tort, negligence, strict liability, or otherwise) and even
if we have been advised of the possibility of such damages. Some
jurisdictions don’t allow the exclusion or limitation of certain
damages, so some of these limitations may not apply to you.
11. Force Majeure
We are not liable for any failure or delay in performing our obligations
when the failure or delay results from circumstances beyond our reasonable
control, including: acts of God, natural disasters, fire, flood, earthquake,
severe weather, pandemic or public health emergency, government action,
war, terrorism, civil disturbance, labor disputes, power or utility
outages, internet or telecommunications failures, venue unavailability,
or actions of third parties (including our ticketing partner, payment
processors, and venues).
In a force majeure event, we will use reasonable efforts to reschedule
the event. If rescheduling is not feasible, refunds will be handled as
described in Section 3.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, without
regard to its conflict-of-law principles. Any dispute arising out of or
related to these Terms or your attendance at an event will be resolved
in the state or federal courts located in Riverside County, California,
and you consent to the personal jurisdiction of those courts.
Before filing any formal legal action, you agree to first contact us at
[email protected] to
attempt to resolve the dispute informally. Most disputes can be resolved
this way.
Any claim must be brought within one (1) year after it arises, or it is
permanently barred.
13. Changes to These Terms
We may update these Terms from time to time. The version in effect at
the time of your ticket purchase is the version that applies to that
purchase. The current version is always posted at
palmspringspinotfest.com.
